Agency Non Compete Agreement
The employer should evaluate this information very quickly and indicate whether or not the company wishes to work on this project. If the Agency is not interested in the project, they must let creators know that they are free to work on the project independently. In short, the Allstate contest prohibits the insurance agent from requesting insurance customers within a mile, or from asking agency clients anywhere. If we were to summarize the law on non-competitions in the states that allow them, we could say this: there must be consideration of a non-competition clause and competition must be reasonably limited to the objective of protecting the goodwill of the company with its existing customers.  The deadline for non-competition bans must apply for a reasonable period of time and is generally set by the state. Non-competition agreements usually take two to three years. Non-compete agreements work to protect the employer or buyer from employees or sellers who claim accounts over which they had some control through production, service or any other form of customer-agency relationship. In an agency or a business acquisition book, this applies to all transactions involved in the sale. A second agreement is warranted to prohibit former employees from taking into account other Agency accounts for which they may have had access to confidential information (regardless of their participation in the client). The problem is that the question of whether the insurance agent «solicited» the agency`s clients is often controversial. A non-compete agreement prevents workers from competing with you during or after their employment. It prevents employees from entering markets or trades with you. Timeout for a fast rant. It always bothers me that the courts say that. It is simply wrong to claim that the harm resulting from the violation of non-competitive competition is always «moral» and «difficult to quantify». In many cases, the damage will be quite tangible and relatively easy to quantify: the amount of profits the company lost by purchasing a product from its customers from the former employee and not from the company. The Staff Directive would require creative staff to take the opportunity to visit the Agency to describe the project, including the timetable and budget, and express interest in the project`s work. The employer must then decide in due course what work will be offered. The judge found that the Allstate competition met these requirements: the appointment to the position of exclusive representative was sufficient, the non-competition obligations protected the legitimate interests of the allstate in its customer relations and confidential information, and the one-year period and the one-mile radius were reasonable.
 As an agent responsible for reading many cases of omission (you can read here some non-competitive omission cases), I should warn you to take these theoretical requirements with a large grain of salt. For example, courts often water down the «irreparable need for injury» to the point that it becomes almost meaningless.
